At the heart of any theoretical problem of justice lies the problem of motivation: Even if we could conceive of a way to develop a comprehensive system of just laws, and even if we could rationally believe in the justice of these laws, how could we ever ensure that we—or anyone else—would be motivated to abide by them? By unearthing how the problem of motivation sways canonical discussions of justice, the article brings forth intrinsic similarities and differences in these discussions (...) that are often overlooked in the literature. In particular, the article highlights intrinsic similarities in the analysis of the concept of justice in two central works that belong to the continental and the analytic tradition respectively and are otherwise rarely discussed together: Hegel’s Outlines of the Philosophy of Right and Rawls’s Theory of Justice. Superman and Batman are close friends and colleagues in the Justice League. But they are very different, especially when it comes to their views on humanity and their opinions of human nature. This chapter discusses the philosophy of Thomas Hobbes and G.W.F. Hegel to better understand these friends’ difference of opinion on humanity and human nature. Superman's view of human nature is much more optimistic than that of Batman and Hobbes. The author claims that Superman and Batman have radically different (...) views on human nature, the state, and society. So perhaps the difference between Superman and Batman is not simply that the former thinks that people are inherently good, whereas the latter believes they are inherently bad. Superman shares Hegel’s belief that human beings rely on and need recognition and external validation of their own worth from other human beings. (shrink)

The Appendix to Kant’s Toward Perpetual Peace is commonly viewed as an explication of the systematic relations between political practice and normative political theory. This paper provides an alternative interpretation of Kant’s main aim in the Appendix which is to provide an argument against the so-called “practical man.” The practical man believes that human nature precludes normative political ideals from ever playing a significant role within political practice. Drawing on the 1793 text “On the common saying: That may be correct (...) in theory, but is of no use in practice,” the paper argues that Kant’s argument against the practical man is based on a proto-phenomenological analysis of moral experience. The practical man’s attempt to describe political practice in purely non-normative terms is, Kant believes, necessarily self-undermining because it denies one of the most basic aspects of human life; the inherent and inescapable normativity of practical reason. Mass incarceration has become a flashpoint in a number of recent political and public policy debates. Consensus about how to balance the just punishment of offenders with the humanitarian goal of providing inmates with genuine opportunities for reconciliation, rehabilitation, and reintegration into society is lacking. Unfortunately, a dualistic “us-versus-them” narrative surrounding these issues has become entrenched, occluding fruitful dialogue and obscuring our ability to see the detrimental effects that our nation’s punitive turn has created. In this essay, we affirm the (...) insights of Wacquant, Clear, and other sociologists and introduce a theological narrative of solidarity and vulnerability that undermines the “us-versus-them” dichotomy and opens up a path for cultivating a “we” community. Plagiarism and other transgressions of the norms of academic integrity appear to be a persistent problem among upper secondary students. Numerous surveys have revealed high levels of infringement of what appear to be clearly stated rules. Less attention has been given to students’ understanding of academic integrity, and to the potential misconceptions and false beliefs that may make it difficult for them to comply with existing rules and handle complex real-life situations.In this paper we report findings from a survey of (...) European upper secondary students’ views on issues relating to academic integrity. We relate these findings to the students’ training about academic integrity, self-reported level of questionable behavior and country of study.A total of 1654 students at 51 institutions located in 6 European countries participated in the study. The participants generally believed they had a good understanding of the rules applying to them and knew how to behave in compliance with norms of academic integrity. The results indicate, however, that often, in practice, this belief was mistaken. Many students had an inadequate understanding of core elements of academic integrity. They were uncertain about how to act, and they struggled in the handling of complex situations that require context-sensitive judgement. While some differences between countries were identified, they were modest and exhibited no clear pattern. Our results also suggest that reducing students’ level of uncertainty and, to a lesser degree, improving their level of knowledge could lead them to engage less in certain types of questionable behaviours. Surprisingly, the effect of academic training is modest and ambiguous. The study also confirms that perception of peer behaviour has the strongest association with student engagement in questionable behaviours. Thus, academic integrity at the upper secondary level cannot be explained simply in terms of individual ethics or knowledge. (shrink)

The amount of data available to healthcare practitioners is growing, and the rapid increase in available patient data is becoming a problem for healthcare practitioners, as they are often unable to fully survey and process the data relevant for the treatment or care of a patient. Consequently, there are currently several efforts to develop systems that can aid healthcare practitioners with reading and processing patient data and, in this way, provide them with a better foundation for decision-making about the treatment (...) and care of patients. There are also efforts to develop algorithms that provide suggestions for such decisions. However, the development of these systems and algorithms raises several concerns related to the privacy of patients, the patient–practitioner relationship, and the autonomy of healthcare practitioners. The aim of this article is to provide a foundation for understanding the ethical challenges related to the development of a specific form of data-processing systems, namely clinical algorithms. Equal freedom is the common starting point for most contractual theories of justice from Hobbes and Rousseau to Rawls. But while equal freedom defines a common starting point for these theories, this does not result in a general consensus on the conception of justice. On the contrary, different ways of conceptualizing the contractual starting point leads to different conceptions of the demands of justice. To fully understand the relationship between equal freedom and justice we therefore first need to explicate how (...) and why the initial condition of equality is transformed into demands of justice. In this paper we discuss how this transformation takes place in the theories of Hobbes, Rousseau and Rawls, with particular emphasis on the vexed relationship between motivation and justification. Medical records are documents of tremendous social importance. They have been the subject of much medical and sociological research, in particular regarding validity, accessibility and readability. This paper uses Conversation Analysis to add an aspect to the understanding of medical records that has been missing so far, namely how medical records are produced as interactional accomplishments; specifically, how hospital staff members during meetings conversationally negotiate and reach conclusions, treatment recommendations, and other types of consequential decisions. The process involves four steps: (...) assessing patients, interpreting implications, drawing conclusions, and dictating conclusions on tape. The key finding is that participants throughout the process orient towards a need for consensus, whilst at the same time acknowledging the doctors’ interactional leading roles. This insight can enhance our understanding of medical records in hospital settings as constructed and negotiated realities. (shrink)

G protein‐coupled receptors (GPCRs) constitute the largest family of transmembrane proteins and play a crucial role in regulating diverse cellular functions. They transmit their signaling via binding to intracellular signal transducers and effectors, such as G proteins, GPCR kinases, and β‐arrestins. To influence specific GPCR signaling behaviors, β‐arrestins recruit effectors to form larger signaling complexes. Intriguingly, they facilitate divergent functions for the binding to different receptors. Recent studies relying on advanced structural approaches, novel biosensors and interactome analyses bring us closer (...) to understanding how this specificity is achieved. In this article, we share our hypothesis of how active GPCRs induce specific conformational rearrangements within β‐arrestins to reveal distinct binding interfaces, enabling the recruitment of a subset of effectors to foster specialized signaling complexes. Furthermore, we discuss methods of how to comprehensively assess β‐arrestin conformational states and present the current state of research regarding the functionality of these multifaceted scaffolding proteins. Trustworthy eco-labels provide consumers with valuable information on environmentally friendly products and thus promote green consumerism. But what makes an eco-label trustworthy and what can government do to increase consumer confidence? The scant existing literature indicates that low governmental involvement increases confidence. This suggests that government should just provide the basic legal framework for eco-labeling and leave the rest to non-governmental organizations. However, the empirical underpinning of this conclusion is insufficient. This paper analyses consumer confidence in different organic food labeling (...) regimes with varying degrees of governmental involvement. Using unique and detailed survey data from the US, United Kingdom, Denmark, and Sweden, the analysis shows that confidence is highest in countries with substantial state involvement. This suggests that governments can increase green consumerism through active and substantial involvement in eco-labeling. (shrink)

Representative for contemporary attempts to establish a science of consciousness we examine Chalmers' statement and resolution of the 'hard problem of consciousness'. Agreeing with him that in order to account for subjectivity it is necessary to expand the ontology of the natural sciences, we argue that it is not sufficient to just add conscious experience to the list of fundamental features of the world. Instead, we turn to phenomenology as the philosophy of conscious experience and give an outline of Merleau-Ponty's (...) critique of the objectivist ontology underlying science which excludes subjectivity from the world. We reconstruct his proposal for a revised ontology in The Visible and the Invisible aiming at an extended understanding of Being including subjectivity, which takes on the form of a constellation of new ontological terms centered around the concept of the 'flesh of the world'. Trying to spell out the consequences of Merleau-Ponty's ontological considerations for scientific practice and especially the science of consciousness, we notice that his philosophy of subjectivity-in-the-world on its part is unable to connect to the insights of the natural sciences. The phenomenological critique of the 'hard problem' reveals a deeper disparity which, at present, limits its practical implications. (shrink)

Alcohol use has been recognized as a challenge in eldercare and social care, and some anticipate that problems related to alcohol use will increase in the future as the current adult generation has high alcohol consumption rates. Accordingly, it is suggested that care workers are at risk of becoming passive bystanders to the destructive lifestyles of vulnerable older adults and even facilitating these lifestyles. In the present paper, we suggest that alcohol exacerbates and underscores inherent difficulties in eldercare, such as (...) finding an appropriate balance between the personal freedom of the older adult and the responsibility of the care worker to provide care. The specific focus in the paper regard the communication and interaction involving values between people in eldercare in cases of problematic alcohol‐related situations to uncover the difficulties. We found it noteworthy that the objectives and perspectives of older adults, care workers, managers and relatives have implications regarding their interactions and communications because their varying experiences involve values that are not necessarily aligned. Sometimes, care workers have no choice but to act against what, in the public sphere and to the other care workers, is ruled out by virtue of their professional ethics. It is suggested that care workers describe and judge situations where alcohol is present paradoxically by virtue of their professional ethics, yet regulate their care to preserve the dignity of older adults, even when they find the situation to be an apparent dilemma. The aim of this study was to explore the ethical challenges in home mechanical ventilation based on a secondary analysis of qualitative empirical data. The data included perceptions of healthcare professionals in hospitals and community health services and family members of children and adults using home mechanical ventilation. The findings show that a number of ethical challenges, or dilemmas, arise at all levels in the course of treatment: deciding who should be offered home mechanical ventilation, respect for patient and family (...) wishes, quality of life, dignity and equal access to home mechanical ventilation. Other challenges were the impacts home mechanical ventilation had on the patient, the family, the healthcare services and the allocation of resources. A better and broader understanding of these issues is crucial in order to improve the quality of care for both patient and family and assist healthcare professionals involved in home mechanical ventilation to make decisions for the good of the patient and his or her family. In this chapter, I argue that one can articulate a historically attuned and analytically rich model for understanding jazz in its various inflections. That is, on the one hand, such a model permits us to affirm jazz as a historically conditioned, dynamic hybridity. On the other hand, to acknowledge jazz’s open and multiple character in no way negates our ability to identify discernible features of various styles and aesthetic traditions. Additionally, my model affirms the sociopolitical, legal (Jim Crow and copyright (...) laws), and economic structures that shaped jazz. Consequently, my articulation of bebop as an inflection of Afromodernism highlights the sociopolitical, and highly racialized context in which this music was created. Without a recognition of the sociopolitical import of bebop, one’s understanding of the music is impoverished, as one fails to grasp the strategic uses to which the music and discourses about the music were put. Although several studies provide evidence that trait self-control contributes to subjective well-being, the way in which self-control promotes happiness and life satisfaction remains unknown. The present study aims to shed light on this relation by investigating the mediating role of four self-control strategies: situation selection, attentional deployment, reappraisal, and inhibition. To test the hypothesis that self-control strategies mediate trait self-control’s effect on well-being, an online questionnaire on trait self-control, self-control strategies, and cognitive and affective well-being was administered to 4,036 participants (...) from four countries (ages 18 to 65 and 56.4% female), whose responses were analyzed using structural equation modeling. Our analysis replicates previous studies that trait self-control positively relates to subjective well-being. Moreover, our analysis provides evidence that this relation is indeed partially mediated by the tendency to employ particular self-control strategies. Attentional deployment and reappraisal positively relate to subjective well-being, whereas inhibition exhibits a negative relation. Situation selection was unrelated to subjective well-being. The incorporation of self-control strategies represents the first attempt to empirically disentangle the positive relation between trait self-control and subjective well-being. The heterogeneous effects of self-control strategies suggest the importance of obtaining a better understanding of which aspects of trait self-control positively contributes to subjective well-being. Studies in experimental philosophy claim to document intuition variation. Some studies focus on demographic group-variation; Colaçoet al., for example, claim that age generates intuition variation regarding knowledge attribution in a fake-barn scenario. Other studies claim to show intuition variation when comparing the intuition of philosophers to that of non-philosophers. The main focus has been on documenting intuition variation rather than uncovering what underlying factor(s) may prompt such a phenomenon. We explore a number of suggested explanatory hypotheses put forth by Colaçoet (...) al., as well as an attempt to test Sosa's claim that intuition variance is a result of people ‘filling in the details’ of a thought experiment differently from one another. We show (i) that people respond consistently across conditions aimed at ‘filling in the details’ of thought experiments, (ii) that risk attitude does not seem relevant to knowledge ascription, (iii) that people's knowledge ascriptions do not vary due to views about defeasibility of knowledge. Yet, (iv) we find no grounds to reject that a large proportion of people appear to adhere to so-called subjectivism about knowledge, which may explain why they generally have intuitions about the fake-barn scenario that vary from those of philosophers. This article examines the term “Radical Enlightenment” as a historiographical category through the lens of the philosophical work of Dorothea Christiane Erxleben (1715–1762), a keen advocate for women’s education and the first female medical doctor in Germany. The aim of the article is to develop a methodological framework that makes it possible to critically assess the radicalism of Erxleben’s philosophical position as it is presented in her highly systematic work Rigorous Investigation (1742). In the first part of the article, the (...) term “Radical Enlightenment” is briefly discussed in the German context. The second part is dedicated to articulating two methodological problems concerning the use of the term “radical” with regards to early feminist writings of the seventeenth and eighteenth centuries. The aim of this section is to develop a new approach to the classification of radical thinkers of this period. In the remaining three parts, this methodological approach is applied to the analysis of Erxleben’s views on equality and education, focusing on her call for women’s active participation in society. Finally, it is concluded that there is sufficient evidence to categorize vital parts of Erxleben’s philosophy as radical. (shrink)

The objective of this paper is to outline challenges associated with the inclusion of welfare issues in breeding goals for farm animals and to review the currently available methodologies and discuss their potential advantages and limitations to address these challenges. The methodology for weighing production traits with respect to cost efficiency and market prices are well developed and implemented in animal breeding goals. However, these methods are inadequate in terms of assessing proper values of traits with social and ethical values (...) such as animal welfare, because such values are unlikely to be readily available from the product prices and costs in the market. Defining breeding goals that take animal welfare and ethical concerns into account, therefore, requires new approaches. In this paper we suggest a framework and an approach for defining breeding goals, including animal welfare. The definition of breeding goals including values related to animal welfare requires a multidisciplinary approach with a combination of different methods such as profit equations, stated preference techniques, and selection index theory. In addition, a participatory approach involving different stakeholders such as breeding organizations, food authorities, farmers, and animal welfare organizations should be applied. We conclude that even though these methods provide the necessary tools for considering welfare issues in the breeding goal, the practical application of these methods is yet to be achieved. (shrink)

Patients sometimes visit their general practitioners with more than one concern. This article investigates when and how patients initiate presentations of such additional concerns. The study is conversation analytic in its approach and scope. It is based upon video-recordings of naturally occurring general practice consultations in Denmark. Data suggest that Danish patients relatively frequently initiate presentations of additional concerns and defer such initiations until moments when the parties would otherwise engage in closing down the consultations. Additional concerns are introduced in (...) response to the doctor’s possible pre-closing remarks. The parties, thereafter, employ a set of transitional elements: confirmation, preliminary announcement and ratification. This transition enables the parties to recycle the activities of the visit, to discuss and examine yet another concern. Thus, additional concerns are not presented completely unexpectedly or randomly as commonsense understanding sometimes has it; they are introduced at orderly moments and by means of recognizable methods. We argue that Recanati burdens his otherwise salutary “Mental File” account of singular thought with an “Actualist” assumption that he has inherited from the discussion of singular thought since at least Evans, according to which singular thoughts can only be about actual objects: apparent singular thoughts involving “empty” terms lack truth-valuable content. This assumption flies in the face of manifestly singular thoughts involving not only fictional and mistakenly postulated entities, such as Zeus and the planet Vulcan, but also “perceptual inexistents,” (...) e.g., Kanizsa figures, rainbows, words and phonemes, as well as hosts of at best metaphysically problematic “objects,” such as properties, numbers, ceremonies, contracts, symphonies, “the sky,” “the rain.” Indeed, reflection on what seems to be the boundless diversity of “things” about which we seem to be able to have singular thoughts strongly suggests that there may be no general metaphysics of objects, much less “acquaintance” and “epistemically rewarding” relations that would distinguish singular from non-singular thought. We recommend that Recanati and other mental file theorists confine the theory to a metaphysically neutral account of singular thought as specific kind of internally “focused” computational state, and not seek any general account of the relation of thought to reality. The vital status of patients who are a part of controlled donation after circulatory death (cDCD) is widely debated in bioethical literature. Opponents to currently applied cDCD protocols argue that they violate the dead donor rule, while proponents of the protocols advocate compatibility. In this article, we argue that both parties often misinterpret the moral implications of the dead donor rule. The rule as such does not require an assessment of a donor’s vital status, we contend, but rather an assessment (...) of whether procurement of organs in cDCD cause the death of the donor or not. We then argue that commonly practiced cDCD protocols do not violate the dead donor rule, since the donation does not trigger or cause the death of the donors. (shrink)

Fascism, according to the Deleuzo-Guattarian perspective and new materialist viewpoints, can be conceived of in terms of desire. In mediating desire’s pure flows, the schizoanalytical programme attempts to bypass what Deleuze calls ‘the strange detour of the other’ (B, 356). In this respect, concepts developed in Gilles Deleuze and Félix Guattari’s Capitalism and Schizophrenia cycle are critical to the project of the problematic of desire, the other and (neo-)fascism. In this chapter, we explore how Deleuzo-Guattarian anti-fascist concepts, such as the (...) Body without Organs (BwO), together with new materialist approaches towards vital materialism, may help us to ‘keep an eye on all that is fascist, even [the fascist] inside us’ (TP, 165). Such a critical-creative analysis, we argue, is needed to distinguish contemporary vitalist new materialisms from so-called Lebensphilosophien (philosophies of life) and frame the rise of neoliberal capitalism-supported regimes of neo-fascism. ExcerptCarl Schmitt's Hamlet or Hecuba (1956) is a peculiar text. For one, it stands out as the only detailed interpretation of a literary work that Schmitt ever produced. This is not to deny Schmitt's overall erudition and familiarity with Western literature nor his particular interest in the intricate relationship between aesthetics and politics, all of which can be traced throughout his writings from the 1910s to the 1950s. But the fact remains that apart from Hamlet or Hecuba, Schmitt did not (...) employ close readings of literary texts as a means to elaborate on his politico-philosophical ideas. Hamlet or Hecuba is…. The past decade has seen an explosion of work on the history of the human sciences during the Cold War. This work, however, does not engage with one of the leading human sciences of the period: linguistics. This article begins to rectify this knowledge gap by investigating the influence of linguistics and its concept of study, language, on American public, political and intellectual life during the postwar and early Cold War years. I show that language emerged in three frameworks in (...) this period: language as tool, language as weapon, and language as knowledge. As America stepped onto the international stage, language and linguistics were at the forefront: the military poured millions of dollars into machine translation, American diplomats were required to master scores of foreign languages, and schoolchildren were exposed to language-learning on a scale never before seen in the United States. Together, I argue, language and linguistics formed a critical part of the rise of American leadership in the new world order — one that provided communities as dispersed as the military, the diplomatic corps, scientists and language teachers with a powerful way of tackling the problems they faced. To date, linguistics has not been integrated into the broader framework of Cold War human sciences. In this article, I aim to bring both language, as concept, and linguistics, as discipline, into this framework. In doing so, I pave the way for future work on the history of linguistics as a human science. (shrink)

The notion of testifying (or testimony) is the central notion of Bolzano's theory of communication. In his Wissenschaftslehre (Theory of Science) Bolzano gives an analysis of this notion. It shows surprising parallels to Paul Grice's attempt to define "A meantNN something by x". I will begin with an explanation of some parts of the analysis and continue with an investigation of the relationship between Bolzano's analysis and that of Grice. In conclusion I would like to present some evidence supporting the (...) hypothesis that several of the virtues of Grice's theory had already been developed by Bolzano, whose approach even has the advantage of a better definition than Grice's, as Bolzano's analysis provides a better basis for defining a notion of successful communication of information. SummaryAt the end of 1910, when the Qing dynasty was on the verge of collapse and the whole Chinese empire in a process of transformation, North Manchuria was devastated by a large pneumonic plague epidemic. The Russian and Japanese governments wanted to use the outbreak of the disease as a pretext to invade north-east China, making plague an issue of international politics. At this dramatic moment the empire relied on the skills of the young Chinese doctor Wu Lien-teh, the first (...) Chinese medical graduate from Cambridge. Wu investigated the disease on the spot, chaired an international plague conference in Shenyang (Manchuria) in April 1911, and, later on, became the figurehead of fundamental public health reforms in Republican China. Highly ambitious, striving for personal fame and international renown for China, supported by an excellent network of personal connections, and equipped with a medical training considered the best in the world at the time, he launched on a startling career as one of China's key medical reformers and international representatives. His history is an example of the inseparable links between personal fate and historical events, and between the interests of scientists, medical men, politicians, and businessmen on the national and international stages.
